These terms and conditions govern the supply of goods by Mothaiba Ltd trading as Nest4Less ("we", "us") to you ("the customer").

Our Contract With You
Accepting your order:
A legally binding contract is formed when we send your order confirmation email.  

**If we cannot accept your order:**  
We will notify you in writing and will not charge you. This may occur due to stock unavailability or payment failure.  

Your order number: 
We will provide an order number once assigned. Please quote this in all communications.

Your Rights To Make Changes
Changing your order: 
Contact us immediately. We will confirm feasibility and any impact on price/delivery. **Changes cannot be made after dispatch.**

Providing The Products 
Required information:  
You must provide accurate details (e.g., name, address, payment) for order processing. Failure may result in delayed or cancelled delivery.  

Responsibility & ownership:  
- You assume responsibility upon signing for delivery.  
- Ownership transfers when full payment is received.  

Delivery:  
- Costs are stated on our website.  
- Estimated delivery times are provided during checkout (details in our Delivery Policy). Time is not of the essence. 
- Delays beyond our control (e.g., courier issues) do not incur liability. We will notify you promptly. For substantial delays, you may terminate the contract for a refund/credit.  
-Failed delivery attempts may result in storage/redelivery fees. You must sign for receipt.  

Late delivery:
You may terminate the contract under UK consumer law if goods are not delivered within a reasonable time. Notify us in writing for a refund/credit.

Your Rights To End The Contract 
Termination rights:
You have rights under the Consumer Rights Act 2015 (e.g., for faulty, misdescribed, or undelivered goods). See Clause 10.2 for details.

Breach by you: 
We may terminate if you fail to accept delivery/collection within a reasonable time.  
Compensation: 
We may deduct costs or charge compensation for breach-related losses.

Return goods by post or arrange collection. You bear return costs. Contact us for a label/collection.

Price And Payment  
Pricing:  
The price (including VAT) is displayed at checkout and confirmed in your order confirmation. We correct pricing errors when identified.  

Payment: 
Full payment is required upon order via debit/credit card. Payment is taken before dispatch.  

Billing issues:  
Notify us promptly if charged incorrectly.

Our Liability  
Loss or damage:  
We are liable for foreseeable loss caused by our breach of these terms.  
Limitations: 
- Liability for an order is capped at its value.  
- We exclude liability for indirect/consequential losses, loss of profit, or business interruption.  
- Liability for death/personal injury or fraud is not excluded.  

Your Personal Information 
How we use it: 
- To process and deliver your order.  
- For payment processing.  
- For marketing (with consent; opt-out anytime).  
Sharing data: 
We only share data where legally required or with your explicit consent.

Other Terms 
Transferring rights: 
We may transfer this agreement to another organisation, notifying you in writing without affecting your rights. You may not transfer your rights.

Severability: 
If any term is unlawful, the rest remain valid.  

Enforcement delay:
Delayed enforcement by us does not waive our rights.  

Governing law: 
English law governs this contract. Disputes may be resolved in English courts (Scottish/Northern Irish courts if you reside there).
